This webinar will give advocates a deeper understanding of supplemental claims in the modernized claims and appeals system. It will help advocates identify when it is appropriate to file a supplemental claim and give them tools to improve the chances of success on such a claim. It will also provide an update about the changes the VA has made to its policies and procedures over the past few months after seeing the implementation of the Appeals Modernization Act (AMA). Advocates need to know about these changes in order to properly advise VA claimants.

Under the AMA, claimants have several options for seeking review of a VA decision that does not grant the requested benefits. A supplemental claim may be used to continuously pursue a claim that was denied in the past year, or to restart the process for obtaining benefits that were denied more than one year ago. Advocates who incorrectly file an initial claim when they should have filed a supplemental claim, or vice versa, risk having the claim rejected by the VA and losing months of retroactive benefits. A complete understanding of the nuances of supplemental claims will help advocates select the best path for obtaining previously denied VA benefits with the earliest possible effective date.

There has also been much confusion among advocates about when a supplemental claim should be filed with respect to a claim for an increased disability rating. Advocates who file an initial increased rating claim when they should seek review of an erroneous denial of an increased rating claim, or who seek review of a correct denial of an increased rating claim when they should file an initial increased rating claim, could cause a veteran to lose years of retroactive benefits. Advocates need to be able to identify the appropriate type of claim to file to obtain the correct disability rating for a veteran with the earliest possible effective date.
